Pima County Superior Court Judge Richard Fields declared a mistrial Friday in the first-degree murder trial of a 28-year-old man.
Jurors swear an oath not to discuss their case prior to deliberations, but the attorneys in the Manuel Jesus Pesqueira case received information jurors had violated that oath, said defense attorney Natasha Wrae.
A new jury will be selected Jan. 29.
Pesqueira is accused of being one of two men who broke into a West Irvington Road apartment on June 29, 2011, seeking drugs and money.
Leonardo Cota-Leyva, 25, one of the apartment’s occupants, was shot in the head and killed. A second man escaped injury.
