A Tucson man was sentenced to 17 1/2 years in prison Thursday for violating his probation for robbery by robbing another business.
In May 2007, now retired Pima County Superior Court Judge Frank Dawley placed Victor Lee Lobato, 26, on five years’ intensive probation after he pleaded guilty to armed robbery for stealing $855 from a Gamestop store. In exchange for his guilty plea, charges pertaining to a string of other robberies were dismissed.
In January 2008, Pima County Justice of the Peace Jack Peyton sentenced Lobato to 18 months probation for domestic violence, to run concurrently with the robbery sentence.
Four months later, probation officers sought to revoke Lobato’s probation when they discovered Lobato was using Heroin and Oxycodone, but Dawley kept him on probation, ordered him to complete residential treatment and extended his probation until July 2012.
In April 2010, Lobato was indicted on 19 counts of armed robbery and 19 counts of aggravated assault with a deadly weapon. The charges stemmed from what authorities said was a spree of violent armed robberies at various stores and businesses between Feb. 16 and March 23.
On Thursday, Lobato was in court to be sentenced for robbing a Gadabout hair salon on March 23, 2010.
Deputy Pima County Attorney Lewis Brandes asked Pima County Superior Court Judge Jose Robles to sentence Lobato to 22 years in prison Thursday, noting Lobato’s poor behavior on probation. Defense attorney Christopher Scileppi asked for a 10 1/2-year prison sentence, noting his client’s dysfunctional upbringing and age.
Robles sentenced Lobato to seven years for violating his probation and to a consecutive 10 1/2 years for the robbery, Brandes said.
Lobato is still facing charges pertaining to another seven or eight robberies committed in 2010, Brandes said.
